City of Jonesboro The City of Jonesboro Mayor and Council held a CALLED MEETING on September 19, 2006. The meeting was held at 170 South Main Street and began at 7:00pm. MEMBERS PRESENT: Luther Maddox,

Sam Durrance, Public Works Director Councilwoman Wenz made a motion to resume the Called Meeting. Councilman Mann seconded. The motion carried unanimously. Settlement Agreement: Councilman Maddox made a motion to authorize the Mayor to sign the settlement agreement as was previously discussed. Councilman Yonce seconded. The motion carried unanimously. 2nd Public Reading: Mayor Day announced the second public hearing regarding the zoning ordinance that involves fortune telling business. The first reading was held at the September 11, 2006 council meeting. She reminded everyone that the zoning amendment was available for public review. Mayor Day concluded the 2nd public reading of the zoning ordinance amendment. Public Hearing: Mayor Day opened the public hearing regarding the zoning amendment and asked for any comments or questions. Mayor Day closed the public hearing for this zoning amendment. Adoption Zoning Ordinance Amendment: Mayor Day called for a motion to adopt the new ordinance. Councilman Maddox made a motion to adopt the Zoning Ordinance Amendment that the city has been read and had the hearing held. Councilwoman Wenz seconded the motion. The motion carried unanimously. Stream Buffer Ordinance: Public Works Director reviewed with the council the NPDES ordinances that need to be updated. The wording needs to be specific to Stream Buffers and Conservation Open Space in order to comply with federal regulations/mandates and the North Georgia Metro Water Authority. Clayton County Water Authority is part of this program. Councilman Maddox made a motion that we adopt the Stream Buffer Ordinance. Councilman Yonce seconded the motion. The motion carried unanimously. Conservation Open Space Ordinance: Discussion was held regarding this ordinance and the possibility of this ordinance superseding current Development Agreements regarding open spaces. Councilman Wiggins made a motion to adopt the Conservation Open Space Ordinance. Councilman Mann seconded. The motion carried unanimously. Right-of-Way Approval: Mayor Day updated council about her meeting with Value Concepts and the need for a waiver regarding city property at 170 South Main Street and corner of McDonough Street and Old Courthouse Way. She requested the council donate the right of way as this will be a construction easement and give her authorization to sign the paperwork. Councilman Maddox made a motion to authorize Mayor Day to sign the construction easement for the right of way project. Councilwoman Wenz seconded the motion. The motion carried unanimously. Mayor Day asked for any other business. Councilman Wiggins voiced concern about Chief Roberts' response at the September 11, 2006 meeting. Councilman Wiggins proposed that he be given authorization to proceed with getting the community room open. Discussion was held regarding what action has been taken by the committee thus far and the need for a line item for the expense of renovation. Councilman Maddox requested that Sam Durrance get a proposal for the council to consider at the October meeting. Mayor Day asked Councilman Maddox to be on the Community Room Committee. He agreed to participate. Councilman Yonce voiced concern about the downtown parallel parking on the streetscape project. The current approved plans will only affect seven parking spaces. Councilman Mann requested the agenda be amended to include Consideration of the Fire Station project. Councilman Yonce seconded. The motion carried with Councilman Mann, Maddox and Yonce in favor and Councilwoman Wenz opposing Councilman Mann made a motion to appoint Councilman Wiggins as head of the Fire Station Project. Councilman Yonce seconded. Under discussion of the liability of having volunteers do the work, possible written contracts. Councilman Maddox asked that the city attorney draw up a waiver for participants to sign. Discussion was held on the bidding process. The motion carried with Councilman Maddox, Yonce and Mann voting in favor of the motion. Councilwoman Wenz opposed the motion and Councilman Wiggins abstained from voting. There being no further business, Councilman Maddox made a motion to adjourn. Councilman Mann seconded the motion. The motion carried unanimously. The meeting was adjourned. __________________________
